  1. VidCAP Software License Agreement
  2. Use of the Software
  3.  
  4. TwinGriffin Works and Paul A. Denton, (the "Author") 
  5. grants you, the end user, a non-exclusive single-user 
  6. license to use the supplied VidCAP ( the "Software") program.  The 
  7. Software and all Intellectual Property embodied in the 
  8. Software always remains the property of the Author.  
  9. Your use of the Software indicates your acceptance in 
  10. full of the terms and conditions of this agreement.

  13. Copying the Software
  14.  
  15. You may make copies of the Software for backup or archival 
  16. purposes only.  You may use the Software on one computer.  
  17.  
  18. The Demonstration version of this Software may be freely 
  19. distributed ONLY if this and all other documentation is
  20. included with the distribution and no attempt is made to
  21. inhibit the acknowledgement of Software's Author or ownership.

  23. Distribution of the Registered Version of the Software
  24.  
  25. The Licensed or Registered version of the Software may 
  26. NOT be distributed in any form without prior written 
  27. consent from the Author.

  29. VidCAP and all associated software and documentation are
  30. copyrighted products of TwinGriffin Works and are protected by
  31. United States copyright law and also by international treaty 
  32. provisions.

  34. All rights not expressly granted here are reserved to TwinGriffin Works.
  35. The use or distribution of these products is expressly prohibited, 
  36. except as authorized by the terms of this agreement.

  38. You may not use, copy, rent, lease, sell, modify, decompile,
  39. disassemble, otherwise reverse engineer, or transfer the licensed
  40. program except as provided in this agreement.

  42. Derived Works
  43.  
  44. You may NOT use the Software to derive any works which 
  45. are based in part or in full on the Software or portion 
  46. of the Software.

  49. Modified Versions of the Software
  50.  
  51. All updated, revised, modified or improved versions of 
  52. the Software are also subject to the conditions of this 
  53. license agreement and shall remain the property of the Author.

  56. Termination of this Agreement

  58. You may terminate this License Agreement at any time 
  59. by destroying the Software along with all copies in any form.

  62. Limited Warranty
  63.  
  64. The Software is distributed and licensed "AS IS".  The 
  65. Author specifically disclaims all other warranties, 
  66. expressed or implied, including but not limited to, implied 
  67. warranties of merchantability and fitness for a particular 
  68. purpose, with regard to the Software.

  71. Damages

  73. By using the Software you do so at your own risk. In no 
  74. event shall the Author be responsible for any damages 
  75. whatsoever (including but not limited to, damages for 
  76. loss of business profits, business interruption, loss 
  77. of business information, or any other pecuniary loss or 
  78. any other real or consequential damages) arising out of 
  79. the use or inability to use this product.

  82. Liability

  84. In the event of failure of the Software for any reason, 
  85. the Author's sole liability shall be to refund the purchase 
  86. price of the Software or to provide a corrected version 
  87. of the Software, at the option of the Author.

  92. The Software and the Intellectual Property embodied in the 
  93. Software shall always remain the property of the Author and 
  94. is protected by United States Copyright Law and International 
  95. Treaty Provisions.

  98. Agreement

  100. Your use of the Software indicates your agreement with the 
  101. above terms and conditions. If you do not agree with these
  102. terms and conditions then you should destroy all copies of 
  103. the software and return the original copy of the software 
  104. (where it has been supplied on diskette) within 14 days for 
  105. a refund.

  112. THIS SOFTWARE IS RELEASED "AS IS" AND WITHOUT WARRANTIES AS TO
  113. PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES 
  114. WHETHER EXPRESSED OR IMPLIED.
  115. Because of the various hardware and software
  116. environments in use, NO WARRANTY OF FITNESS FOR A PARTICULAR 
  117. PURPOSE IS OFFERED.
